    The law requires the stamp and signature of a licensed Notary Public for many types of documents to become legally binding. Raeshelle, a licensed mobile notary public based in Chico, California will make this process easy and convenient. You might think that hiring a notary public will be expensive and burdensome, but it’s much more affordable than you think. It’s also more convenient when working with a Mobile Notary Public because they will come to you.

    Two Common Certificates Used For Notarizing

    There are two common Notary Certificates used for performing a notarization. As a Notary, we cannot tell you what type of Certificate you need. If the document needing Notarized doesn’t have the Jurat or the Acknowledgement on document, you should ask the party who is requiring the Notarization. As with all notarizations, a Valid form of ID is required. If you don’t have a valid Identification, you may prove your identity through the oath or affirmation of a credible witness known to the notary or two (2) credible witnesses not known to the notary. All witnesses must have Valid Identification.

     

    Jurat

    The person needing the document notarized is required to be in front of the Notary Public, it also necessitates the person signing the document take an oath and affirmation, under penalty or perjury, stating that the contents and statements in the document are truthful. Once an oath or affirmation is administered, the signer then signs and dates the document. After which, the Notary Public will sign and stamp. You will then be asked to sign in the Notary Public’s record book. It is always best not to sign documents that need to be notarized until you are in front of the Notary. If you do, you will need to cross out the signature and resign the document.

     

    Acknowledgement

    The acknowledgement confirms that the signer was in front of the Notary Public and the Notary Public has confirmed the identity of the person who is signing the legal document. If you are seeking an acknowledgement, you must appear before the Notary Public and present a Valid Identification. If no personal identification documents are available, you may prove your identity through the oath or affirmation of a credible witness known to you and the Notary Public or two (2) credible witnesses not known to the notary but knows you.

    After each notarization, the notary will fill out their record book and ask you to sign where she has filled out your recorded transaction. Depending on the document, you may also need to give your thumb print.

    Signature By Mark

    When the signer of an instrument cannot write/sign) his or her name, that person may sign the document by mark. ( Civil Code section 14) The requirements for notarizing a signature by mark ate as follows:

    The person signing the document by mark must be identified by the Notary Public by satisfactory evidence ( Civil Code section 1185 )
    The signer’s mark must be witnessed by two persons who must subscribe (sign) their own names as witnesses on the document. One witness should write the person’s
    name next to the person’s mark and then the witness should sign his or her name a witness. The witnesses are only verifying that they witnessed the individual make his or her mark on the document. A notary public is not required to identify the two persons who witnessed the signing by mar or to have the two witnesses sign the notary public’s journal. Exception: If the witnesses were acting in the capacity of credible witnesses in establishing the identity of the person signing by mark, then the witnesses’ signatures must be entered in the notary publics

    What is the purpose of a Notary Public?
    Raeshelle’s Mobile Notary’s purpose it to prevent fraud and forgery. They do this by verifying the identity of individuals requesting their documents notarized depending on the certificate needed for the document, an oath will be giving and their signature needs to be witnessed by the Notary Public.

    Does a Notary Public keep records?
    Raeshelles’s Mobile Notary is required to keep a journal of all the documents they have notarized with the date, type of certificate notarized, signers address, the location where the documents were notarized, the signatures and thumbprints of the signer. This journal is kept under lock and key when not being used. If the Public Notary ends their Commission, the journal(s must be turned in to the County Clerk of Court.

    Can Raeshelle’s Mobile Notary notarize their own documents or for their relatives?

    A Notary Public cannot notarize a document for themselves. A Notary Public may notarize documents for relatives or others, unless doing so would provide a direct financial or beneficial interest to the Notary Public. Given California’s community property law, care should be exercised if notarizing for a spouse or a domestic partner.
    A Notary Public would have a direct financial or beneficial interest to a transaction in the following situations (Government Code section 8224):

    No. Raeshelle’s Mobile Notary cannot give advice on how to fill out your document. That could be considered practicing as an attorney. If you have questions about the document you are getting Notarize, it is best to talk to the entity that is requiring the notarization or your attorney for advice.
